The administration signals piracy related issues around the world, listing 36 countries in total. Canada has been downgraded from the Priority Watch List to the regular Watch List after signing a new trade agreement. Every year the Office of the United States Trade Representative (USTR) publishes its Special 301 Report highlighting countries that aren't doing enough to protect US intellectual property rights. The format remains the same as in previous years and lists three dozen countries that, for different reasons, threaten the intellectual property rights of US companies. "The identification of the countries and IP-related market access barriers in the Report and of steps necessary to address those barriers are a critical component of the Administration's aggressive efforts to defend Americans from harmful IP-related trade barriers,"USTR writes. The topics reported in the yearly overview are much broader than online piracy. They also cover counterfeiting and other IP related issues, including patents and protection of trade secrets. Our coverage is limited to piracy, however, which remains one of the key issues. The USTR highlights stream-ripping as a significant problem, as well as pirate IPTV services and “illicit streaming devices” in general. The latter are sold throughout the world but are often manufactured in China, which is listed on the USTR’s Priority Watch List. “Stakeholders continue to report rampant piracy through ISDs, including in Argentina, Brazil, Chile, China, the Dominican Republic, Hong Kong, India, Indonesia, Mexico, Peru, Saudi Arabia, Singapore, Taiwan, the UAE, and Vietnam. China, in particular, is a manufacturing hub for these devices,” the USTR writes. Camcording piracy, where people record films at movie theatres, remains a significant problem as well. Russia, India, Mexico, and China are called out as frequent sources, but the problem applies to other countries as well. The USTR notes that countries including Argentina, Brazil, Ecuador, Peru, and Taiwan do not effectively criminalise unauthorised camcording, and hopes that this will soon change. "The United States urges countries to adopt laws and enforcement practices designed to prevent unauthorised camcording, such as laws that have been adopted in Canada, Japan, and the Philippines," the USTR writes. Most of these observations and comments are not new. They are made year after year in some cases. Apparently, it's a strategy that has some effect. For example, India recently updated is camcording legislation to allow a three-year prison sentence for those who get caught. The full list of countries which lack proper IP protect ion totals 36. Eleven are listed on the most severe Priority Watch List with the rest placed on the regular Watch List. However, problems remain as well. Among other things, the US sees Canada's copyright exception for educational purposes as a grave concern. "The United States remains deeply troubled by the ambiguous education-related exception added to the copyright law in 2012, which has significantly damaged the market for educational publishers and authors, the office writes. Switzerland also remains on the Watch List. While the country generally has strong intellectual property protection, the U.S. remains concerned about its online copyright protection and enforcement, as we've highlighted previously. This appears to be the only remaining barrier at this point. If countries fail to address the issues the USTR has highlighted, the U.S. says it will take appropriate actions in response. No concrete measures are mentioned, but they can include enforcement actions under Section 301 of the Trade Act or pursuant to World Trade Organisation rules, for example. The stated intent has nothing to do with supposed furtherance of creative activity by 'protecting' people making orig inal works from said works being commercially exploited by others. 'Rights' are commodities for trading. They have no connection to promoting vibrant participative culture. Copyright terms are merely means for persons (in general publishers/distributors) to keep accruing income without further effort; meanwhile they prevent other people from taking forward innovative ideas whilst still fresh; cultural progress is perforce at snail's pace because each next step must wait for "70 years + life". The second quotation highlights the philistine modern underpinning of copyright. Acquisition of knowledge must play second fiddle to acquisition of money. Of note is the placing of 'publishers' before 'authors' when bemoaning Canada's previous stance on education exemptions. Unwittingly, with regard to the minimal wit writers of such garbage can muster, it's acknowledged that publishers/distributors are the primary interests to be protected; this because they take the lion's share of income generated. | Bullying other countries is an understatement, for example they have effectively bent Australia over the conference table (so to speak), I wouldn't be surprised at some point if Australia becomes part of the U.S once Queen Elizabeth dies and Australia becomes a republic! The internet laws in Oz are so ridiculous... I would liken them to the bad half of Korea, they've banned most torrent sites, most alternate porn and so much else it's beyond a joke. In fact... they have banned almost everything the U.S has and oh so much more.... And our government is so obsessed with the U.S that they teach American business practices in schools, we used to have our own business strategy which was based on fairness and quality, now any actual quality products we make go straight to the U.S, even our Aussie car designs, meanwhile we get a cheap in-efficiant version of our own cars while the U.S gets the proper ones, they have sold ALL our important commodities to the U.S like our power and phone networks... we now have the most expensive internet (and still don't have legitimate "unlimited data" - we pay a fortune monthly to just get around 250GB of data, the best plans we have only go as far as 1TB, and then you pay around 4 times as much for every bit over your data plan), the Aussie governments now track ALL metadata - making VPN's imperative to privacy, and even youtube in Australia is different, a lot of stuff that Aussies upload there cannot be viewed by Aussies??? how f'ed up is that!?!?! We have began becoming oppressed and even the news is heavily monitored by the government for ANYTHING they disagree with, whole networks and or news corporations are closed down if they attempt to talk about "unapproved" subjects! As much as the U.S has brought Australia some good things, and advancements, we only ever get stuff that has become obsolete! While the U.S was enjoying the DVD we were only being sold "Laser Disc", and we have only just got the internet upgraded, but to a version that is out dated even to 3rd world countries, they have made our power bills the most expensive in the world - seriously! the average power bill in Australia comes close to $1000 over 3 months 8o and we have limited access to computer accessories, we do not have "burner" mobile phones, ALL mobile phone connections are monitored by the government, and you can't even buy a mobile phone without I.D. We even now have a Chinese military base near the harbour in Western Australia (approved by our government) that can support enough Aircraft and resources to overthrow our country at any time (there was no warning and the government prohibited the news from even talking about it), our government are sellouts to the highest bidder... and normally that's the U.S, our government a few years back even brought a heap of planes from the U.S that were deemed unsafe by the U.S, yet they still sold them to our government knowing that our government will do anything to impress the U.S. I personally call Sydney little L.A it has become so very American in it's laws, it's look, and even it's business'....... Hey Canada - can I move in!!? Heck I'd settle for Mexico at this point there would still be more freedom and opportunity there for Aussies than there is in Australia, but if you are a U.S citizen then our government will do everything it can for you :-( This was a wonderful and unique country once.... . but not anymore. Even our mining resources are all being sold to the U.S, we sell our coal to Asia and then have to buy it back at around 5 times what we sold it to them for 8o As my grandfather used to say..... "God save the Queen" because when she goes, so will the rest of our rights/freedoms, produce and resources. May the great spaghetti monster in the sky save us all in Australia!!! | |

| Hi there MissKitti – and thank you for your detailed and impassioned response. And yes, I hear what you are saying about Australia. It is a great pity when a country as talented and as resourced, takes the easy way out and flakes to greater powers [i.e. the U.S + China etc.]. And yes, things have changed – generally for the worst, with the gap between the rich and the poor widening to an alarming level. As usual, man-made greed, a lust for power, and a desire to influence and control, dominates Australia’s present landscape. I will be watching closely in the near future as I hear they are about to have a national election. My spies inform me that there is a possibility that those lefty, tree-hugging [global warming etc. etc.] socialists [the labour party] might just scrimp in. It will be interesting to watch and see if such potential victors of the aforementioned election take a different perspective in regards to the running of Australia. In relation to the tracking and monitoring of which you speak, unfortunately, this is but a sign of the times, and I believe such laws are unlikely to be repealed. Conversely, at least Australia isn’t as bad as the U.K. or Europe. It appears that recent sweeping changes to copyright laws in those places is going to be quite draconian. Nevertheless, always remember there are those who are dedicated to fight such rubbish [as detailed in my original post], such as Mozilla Firefox, The Electronic Frontier Foundation, GitHub, SourceForge, and many other open source developers who stand strong and refuse to be repressed. | That's actually wrong. Anyone can buy a phone, but you need I.D to activate a sim card. Even prepaid. And as annoying as it may seem sometimes, I see it as a good thing. Last thing I want is if a few people who don't like me get my number, they can call/spam/annoy me as long as they want. Do it now, and that number goes back to someone that can be identified. | |

| thank you for your reply, I am aware it's the SIM that requires ID, a phone without a SIM is just a small media player! But my point is, that I don't like being constantly monitored by an oppressive government - regardless of what flag they wave (especially since our government has sold us out to foreign governments), it's insecurity that is allowing our government to monitor EVERYTHING we do! For example... did you know that the government can turn on your mobiles microphone without you knowing? And can monitor ALL your messages and calls! BUT if they don't know who owns the phone they have NO interest in doing so, this is not what the ANZACs fought and died for! They fought and died for our FREEDOM, not for our government, and only partly for the Queen, but if you took away the government and the Queen from that equation they would have still gladly fought for our freedom, but if you take away the freedom, only a few would have fought for the Queen or government, and you forget that there is such a thing as a public phone box - which is actually where most of the calls you referred to come from my friend (no disrespect intended). Most people aren't silly enough to use their own phone for these purposes as they know they can be traced. I don't even have a mobile phone anymore as the concept of a mobile phone has become near meaningless - as most communications between people and even business' - is usually done on the internet, at least the internet is providing some privacy (especially with a VPN). :love - and yes I know a lot of people use their mobile for the internet, but since you can equally use an XBox or an iPad etc. there would be no less convenience other than a phone fits in your pocket, but tell me this... as a result of carrying their phone with them - what percentage of people do you think have their phone ruined by the SOLE fact that it's in their pocket (a disturbingly high number). + Generally these days if someone wants to torment you, they will do it on social media, not spend money on a mobile call! They prefer social media sites as they can always find others who agree with them - even if they've never met you! And to suggest that it makes life more secure is like suggesting that we should remove all public phones because they aren't secure enough! Yet if we did get rid of public phones 100s of thousands of people each year would die because they don't have a mobile, OR the battery was flat, OR the phone had no reception, OR the phone was broken or simply out of credit! 8o ..... ... .. . (and that's just in Australia alone) :idea these are things that are often overlooked 8) | |
