| The Wayward Special Counsel Here's an interesting opinion piece! An Opinion, By RICH LOWRY, POLITICO MAGAZINE Rich Lowry is editor of National Review and a contributing editor with Politico Magazine. May 29, 2019 In the end, the by-the-book Robert Mueller wildly departed from the book. He invented an extraconstitutional legal standard for his obstruction investigation and acted, at the very least, in violation of the spirit of the special counsel regulations. His departing act was a public statement meant to influence the public debate in a manner inappropriate for a prosecutor, in part because the public report he wrote that was inappropriate for a prosecutor failed to achieve clarity despite its hundreds of pages. A hallmark of the Trump era is that the norm-defying president goads everyone appalled by him to violate norms. The retired Marine and former G-man would seem least likely to fall prey to this dynamic, but here we are: He has put on a master class in how a prosecutor shouldn’t behave. First and foremost, Mueller ditched the presumption of innocence, a bedrock of the American legal system. In the normal course of things, all of us are considered innocent unless a jury finds us guilty beyond a reasonable doubt. Mueller switched this around. Rather than finding conclusive evidence of Trump’s guilt, he had to find conclusive evidence of his innocence. Because he didn’t find this exculpatory evidence, he deemed Trump “not exonerated,” a standard heretofore unknown to the American system. As he put it in his news conference, in surely one of the more gobsmacking utterances ever made by someone from a Justice Department podium, “If we had confidence that the president clearly did not commit a crime, we would have said so.” If this standard had been applied to any person other than Donald Trump, it would have been widely denounced and the American Civil Liberties Union would be crusading to keep it from ever emerging again in any context in America. It is profoundly inimical to due process as understood under our Constitution and puts the burden of proof on the accused—exactly what our system seeks to avoid. Naturally, Trump’s critics concluded from Mueller’s statement that if Trump hadn’t been found innocent, he must be guilty. The snarky headline on a New York magazine piece put it aptly enough, “Mueller: Trump is Not Not a Criminal.” Well, you might say, of course Mueller departed from standard operating procedure—he’s a special counsel operating in novel circumstances that require novel approaches. But this is not his writ. A special counsel, under the regulations, is not a freelancer making it up as he goes along. He has the “investigative and prosecutorial functions of any United States attorney.” He is supposed to “comply with the rules, regulations, procedures, practices and policies of the Department of Justice.” It is one of the those rules that has caused so much confusion over the obstruction portion of the Mueller report. The DOJ’s Office of Legal Counsel has said a sitting president can’t be charged with a crime. Mueller explained in his public statement that this ruling led his office to conclude it could “not reach a determination one way or the other about whether the president committed a crime.” So, Mueller by his own account, conducted a two-year investigation knowing from the beginning that he wouldn’t make the either/or decision that prosecutors exist to make. Attorney General William Barr was right when he told the Senate Judiciary Committee, “At the end of the day, the federal prosecutor must decide yes or no.” Mueller decided neither. Mueller offered several reasons in his statement for conducting an obstruction investigation anyway. One was to preserve evidence. But for what? The idea that Trump, after losing reelection in 2020, would be prosecuted as a private citizen for firing FBI Director James Comey is manifestly absurd. Another was that a president can be accused of wrongdoing in “a process other than the criminal justice system,” i.e., impeachment by Congress. Here, Mueller is basically describing Volume 2 as an impeachment referral. But this isn’t a purpose contemplated by the special counsel regulations, which, again, were written to tether special counsels to Justice Department practice. The regulations say that the special counsel “shall provide the Attorney General with a confidential report explaining the prosecution or declination decisions.” They don’t say a special counsel shall fail to reach a prosecution or declination decision, then write a long report for congressional consumption anyway and go out and make a public statement to catalyze congressional action if he thinks his report is being misread. That Mueller was effectively conducting an impeachment inquiry from within the executive branch represented a significant distortion of our system. It should be up to Congress, not an inferior executive branch official who’s the functional equivalent of a U.S. attorney, to launch such an inquiry. Even more bizarrely, because Mueller considered Trump’s public statements as potential obstruction, any objections by the president to this quasi-impeachment inquiry were more evidence of alleged wrongdoing. An institutionalist who lost his way, Mueller will be lionized for the duration because he’s been so useful to Trump’s opposition, but his performance won’t age well—and shouldn’t. | |

As mentioned previously I had uploaded DWH last night (at 9:10 pm); I had also uploaded TB this morning (at 4:26 am). I have just recently uploaded the rest of the MSNBC lineup of shows derived from MLs; these had been DLed hours ago, some more than 12 hours ago. However, some of you may be itching to DL them. Virtually all shows also have nfos (information files), for Scene shows these are posted by the releasing group or individual, for non-Scene posters, such as Pawpcorn, I create nfos. The nfo shows who posted it, when, the original filename, run time, size, and URL. Especially since I was planning to upload this fine show for others, I adhere to my standards, and with all due respect to Pawpcorn, his filename is a description of the show, rather than an actual title. The additional information, "720p WEBRip x264-PC" is good to know, and I do retain it, but only in the show's detailed nfo. I do hope this did not perturb him in any way. I had given him proper credit in the message where I posted it. For myself, I do not feel a need to keep '720p' in the filename; I got that when I DLed it, and can often discern it from the larger file size. I prefer how my files actually look, and the information in the filename is what I think is most important, at least to my tastes. drhankh | |

| I've been trying to catch up on my viewing and refrain from posting any more messages, but I see that BB has posted MJ's link rather early. I had already uploaded 3 good segments from TLW that I had just recently finished watching. So I added MJ (gs hs) and two of tonight's shows, DWH and TB, that I generally try to watch. Trump worked with the Russians, our formidable adversary, to get elected. He is a Russian asset. As Cynthia Alksne, a former federal prosecutor stated, Barr is a liar, as is Trump. They have been systematically engaging in obstruction of justice, aided and abetted by GOP quislings. To put it succinctly, Barr has engaged in lies, obstruction and failure to carry out his sworn oath of office; while not convicted, he IS a criminal. So Mr. Mueller's desire to do things a certain way is based on his past experiences, where AG's were honest -- not conspiring to obstruct justice and to protect a criminal, illegitimate "president." Hence, the situation is fundamentally different, and he cannot in good faith leave it to 'others' (Congress), where parties are severely compromised (Republicans) or severely obstructed (Democrats - being stonewalled by Trump and his underlings). Let's face it, you have an extremely corrupt leader with excessive power. and while I do understand that Mueller wants to stay out of the limelight and leave it to others to do what's necessary, he ignores the salient fact that the others lack sufficient power, and this nation truly needs all the help it can get, including and especially from Robert Mueller and his team. History is calling him, and this prescient moment in time requires the best, the brightest, the most courageous and the most consequential team to defeat this nakedly transparent evil. The longer Trump is in office with his enablers, the greater the damage he can do, and the harder it will be to undo (if it can be done at all) and the suffering of innocents could be untold. The Nazis' Final Solution did not arise out of nowhere, and the only way it truly was stopped was by a great alliance of powers and brave individuals, the U.S., Great Britain, the Soviet Union, the Free French and Poles in exile, the French Resistance, the OSS and British intelligence, exiled scientists who completed the Manhattan project, and the group who eventually formed the Mossad. The Nazis were stopped but not before some 60 Million lost their lives. As MSNBC coverage has documented, already at least 6 children (of people fleeing tyranny) who were detained by ICE have died. The top leadership of the FBI was purged. An election was stolen, along with two Supreme Court seats. I fear that things may have to get a lot worse before enough people will realize that urgent action is needed, and the sooner the better. Flannery II, Ari's frequent guest, who I quote here and have praised in the past. He is a former prosecutor who has also worked in Congress three times. I could tell he was well educated; he appears to me to be a true renaissance man (or polymath). He studied art (painting), dramatic arts, martial arts (including a black belt in Tae Kwon Do; judo), got a dual major B.S. in physics and engineering, a law degree (J.D.) and further study in graduate school for information sciences. So he is well versed in several fields. For those wondering, Seneca (c. 4 BC - AD 65), was a Roman philosopher, statesman, and dramatist. And in case anyone is wondering, or hasn't figured it out, yes, I am watching many of these MSNBC shows, including many that I am sharing, but yes, I am also studying them, as well as related matters. Why? This in my estimation is a pivotal point in human history. I believe we are approaching a momentous date with destiny. Like two of Gene Roddenberry's fictional characters, Gary Seven from "Assignment: Earth" (Star Trek TOS) and Questor from The Questor Tapes, things happen for reasons, there are patterns at work, all is not random, and John Flannery understands this. > The Preamble > We the People of the United States, in Order to form a more perfect > Union, establish Justice, insure domestic Tranquility, provide for the > common defence, promote the general Welfare, and secure the Blessings > of Liberty to ourselves and our Posterity, do ordain and establish > this Constitution for the United States of America. During World War II, Hitler nearly succeeded in exterminating the entire Jewish population, of Europe at least. Yet Jews existed in the rest of the free world, especially in America, and used extrajudicial means to save as many of their people as possible, knowing grimly that despite their best efforts, the vast majority would perish in horrific fashion. But that effort led the Jewish people to retake their ancient country of Israel and restore it, along with its ancient language of Hebrew. The underground organizations that rescued Jews and fought the British in Palestine eventually led to the Mossad, who captured Eichmann, later executed. However, to ensure that "God's chosen people" never again suffered an attempted genocide, Israel not too secretly developed a formidable arsenal of atomic weapons and the capabilities to deliver them. Similarly, wise leaders, especially after enduring great hardships, develop contingency plans to deal with possible future emergencies of a grave nature. I remember when I taught my high school physics class and we visited a U.S. Army facility to see a laser, and later learned even more about it, that when energy of sufficient amount is harnessed and focused on a small point, it can cause devastating damage. Trump has accumulated much power, has helpful aides, like Barr, and many GOP allies in Congress, and has his own skills, including his mastery of mass communications. None of this is to be underestimated. However, he has made more and more enemies, and while his repeated lies and coverups have had significant success, just like Hitler overreached when he attacked Russia -- setting in motion an alliance of great powers that defeated him, Trump has created so many enemies and opponents in so many areas (the media, the FBI, law enforcement, intelligence and government) that he has increased the risk greatly that his opposition may coalesce against him, especially is he seems to go too far or too much damaging information is revealed. Mueller and SDNY looked into a lot but certainly not everything. There are other high crimes, such as treason, e.g., working with the Russians to steal the election, where if fully exposed, will cause Trump to be seen as a traitor and a danger. So I study; there is a danger, and it is best for everyone if this danger is dispelled by the removal of Trump and Pence from office. And hopefully at some point, just like Nixon did, they will resign. I realize many of you just watch the shows, but I'm sure many of you find Trump to be worrisome. drhankh | |

| Not sure why Pawpcorn posted Rich Lowry's column from Politico or why BB Liked it (apparently he likes everything that Pawpcorn posts), but Lowry is a well-known conservative with only a B.A. degree, and he's certainly no lawyer and does NOT know what he purports to be opining on. To understand this issue properly, I refer everyone to Neal Katyal, fmr Acting Solicitor General, a very accomplished lawyer, who in fact, wrote the DOJ Special Counsel regulations. Neal has discussed these issues several times at great length and with real authority -- and on MSNBC shows including The Beat, The Last Word, Morning Joe and All In. Lowry merely rehashes right-wing talking points, and it's disgraceful. He's also a frequent guest on Fox News Sunday. drhankh | |
